As a partner at AsherKelly, Lyndsey Bates provides employee benefits, labor, and employment law advice to multiemployer fringe benefit funds, trade associations, municipal retirement and health systems, and private employers. Her practice focuses on Taft-Hartley fund representation, ERISA litigation, and ERISA and Internal Revenue Code compliance.
Lyndsey has extensive experience representing clients in Department of Labor (DOL) compliance audits and has successfully guided numerous clients through all stages of the audit process to favorable outcomes. She has represented clients before the Ontario Labour Relations Board (OLRB), the National Labor Relations Board (NLRB), the Equal Employment Opportunity Commission (EEOC), the Michigan Department of Civil Rights (MDCR), and in various state and federal courts.
Lyndsey has extensive knowledge in data security and cybersecurity compliance, including advising employee benefit plans on the DOL’s Best Practices Guidance. She is uniquely positioned to assist plans in both preventing and responding to data breaches.
In addition, Lyndsey counsels clients on a wide range of complex employment matters, including workplace policies and handbooks, leave laws including the Family-Medical Leave Act (FMLA), wage and hour compliance, workplace harassment and discrimination, and employment and non-competition agreements.
Lyndsey has been named a Michigan Super Lawyers Rising Star each year from 2022 through 2026.
